Probate
Often because of poor Estate Planning, a probate may be necessary after someone dies. The probate court will admit the Last Will and Testament to probate, appoint and supervise the actions of the personal representative, rule on the legitimacy of any creditors' claims, and supervise the transfer of the remaining estate property to the beneficiaries named in the will, or to the heirs, if the person died without a will. Probate can be quick, informal and unsupervised, or long, formal and supervised by the court. It can take as little as four months or as long as several years.
